Terms and Conditions

These are Kablooey’s terms of use, and they apply to all users of the Kablooey platform. By using Kablooey you agree to these terms and to the other policies we post. Please read them carefully and let us know if you have any questions. For information about our data practices, please see our Privacy Policy. We collect and use your information in accordance with those policies.

The Lowdown

  • You own your content.
  • Kablooey won't share or sell your personal information.
  • Only post images and links to content appropriate for 13-year-olds and Aunty May to see.
  • Be respectful of the diversity that defines today's comic creators and readers.

Your account

You must be at least 13 years old to register for an account. When you create an account you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us immediately if you believe your account is compromised.
 

Abusive conduct

You are responsible for all activity on your account. If you violate our policies we may terminate your account. Don’t do anything illegal, abusive towards others, or that abuses our site in a technical way. Kablooey will not tolerate harassment and abuse, especially due to ethnicity, sexual orientation, sexual identity, or religion.
 

Your Content

You keep complete ownership of all creations, but you give us permission to use them on Kablooey. If you do not own an image, make sure you have permission to use images that you post on Kablooey.
 
You keep full ownership of all creations that you offer on Kablooey, but you grant us a strictly limited license to use your content in the context of displaying posts with text and images, marketplace items, and other necessary website functions. We will never try to steal your creations or use them in an exploitative way. You may not post creations that infringe others’ intellectual property or proprietary rights. You may not use or post any work owned and posted by creators of said work in any way not authorized by the creator.

Copyright: Don't copy and post an illustration from a creator's account without their permission. You can post images of books and art you have purchased or are selling. You may post historical comics pages and art for educational purposes. You may post excerpts of books for review purposes.

Violence: You may not threaten violence against an individual or a group of people. We also prohibit the glorification of violence.

Abuse/harassment: You may not engage in the targeted harassment of someone, or incite other people to do so.

Hateful conduct: You may not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.

Sensitive media, including graphic violence and adult content: You may not post or link to media that is excessively gory, violent, or sexual. Do not post or link to images containing nudity or that overly sexualize or objectify the subject.

As a general rule, don't post anything inappropriate for a 13-year-old to see or anything that Aunt May would chastise you about.

Illegal or certain regulated goods or services: You may not use our service for any unlawful purpose or in furtherance of illegal activities. This includes selling, buying, or facilitating transactions in illegal goods or services, as well as certain types of regulated goods or services.
 

Selling on Kablooey

Kablooey offers a method for you to advertise your comics, art, and books for sale in the Marketplace, which can be found in the menu. Kablooey does not facilitate financial transactions and collects no payment or sales information. You can either add a link to another website such as Amazon or your own website, or you may rely on users using the "Contact Seller" button. This will allow the user to contact you via email, where you can make payment and shipping arrangements. Kablooey users who abuse the Marketplace with adult content, malicious links, unfulfilled orders, or other abuses will have their account deactivated. Users can report bad guys at admin@kablooeycomics.com.
 

Account deletion

To summarize: You can delete your account in your account settings, which you can get to with the upside-down arrow button at the top right of the page. We can terminate or suspend your account at any time at our discretion. We can also cancel any content, posts, or marketplace items at our discretion. You may not bring a claim against us for suspending or terminating another person’s account, and you agree you will not bring such a claim. If you try to bring such a claim, you are responsible for the damages caused, including attorneys fees and costs. These terms remain in effect even if you no longer have an account.
 

Kablooey's Creations

Our creations are protected by copyright, trademark and trade secret laws. Some examples of our creations are the text on the site, our logo, and our codebase. We grant you a license to use our logo and other copyrights or trademarks to promote your Kablooey page. You may not otherwise use, reproduce, distribute, perform, publicly display or prepare derivative works of our creations unless we give you permission in writing. Please ask if you have any questions.
 

Indemnity

If we are sued because of your use of or conduct on Kablooey, you have to help pay for it.
You will indemnify us from all losses and liabilities, including legal fees, that arise from these terms or relate to your use of Kablooey. We reserve the right to exclusive control over the defense of a claim covered by this clause. If we use this right then you will help us in our defense. Your obligation to indemnify under this clause also applies to our subsidiaries, affiliates, officers, directors, employees, agents and third party service providers. Whew!
 

Warranty disclaimer

Kablooey is provided “as is” and without warranty of any kind. Any warranty of merchantability, fitness for a particular purpose, non-infringement, and any other warranty is excluded to the greatest extent permitted by law.
 

Limit of liability

To the extent permitted by law, we are not liable to you for any incidental, consequential or punitive damages arising out of these terms, or your use or attempted use of Kablooey. To the extent permitted by law, our liability for damages is limited to the amount of money we have earned through your use of Kablooey. We are specifically not liable for loss associated with unfulfilled benefits and from losses caused by conflicting contractual agreements. For this clause “we” and “our” is defined to include our subsidiaries, affiliates, officers, directors, employees, agents and third party service providers.
 

Dispute resolution

We encourage you to contact us if you have an issue. If a dispute does arise out of these terms or in relation to your use of Kablooey, then the dispute will be resolved in the federal or state courts located in South Carolina. Both parties consent to the exclusive jurisdiction and venue of the South Carolina courts for the purpose of resolving any such dispute. South Carolina law, excluding its conflict of law provisions, governs these terms, all other Kablooey policies, and any dispute that arises between you and Kablooey.
